PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING ANY WEBSITE OR PLAYING ANY GAME OF SYNERGETICA LLC.
This Terms of Use ("Terms") is a legal agreement between you and Synergetica LLC ("Synergetica") and governs the use by you of Synergetica’s website, services, games and applications (collectively, the "Services"). By using the Services you agree to these Terms of Use. If you do not agree to these Terms, do not acquire or use the Services.

By using our Services you are agreeing to our Processing of your data as set in this Privacy Policy now and as amended by us any time.

1. INTRODUCTION AND AGREEMENT TO THESE TERMS OF USE

By using our website, playing our games or using any of our applications, products or services you confirm that you have read, understood and agree to adhere to these Terms and agree to the collection, use and storage of your information as outlined in Synergetica’s Privacy Policy.

If you do not consent to the Terms now, or if at any time, the Terms are no longer eligible to you, please terminate using our Services instantly. These Terms constitute a binding agreement between you and Synergetica.

Synergetica retains the right to refuse any user access to the Service without any notification, including, but not limited to, any breach of the Terms.

2. LICENSE AND RESTRICTIONS

Subject to these Terms, Synergetica grants you a revocable, non-exclusive, non-transferable limited license to use the Services for your personal, non-commercial use. You cannot:

• modify, translate, decompile, disassemble, reverse-engineer, reverse-compile create derivative works of, or use data gathering or extraction tools in connection with the Services;
• duplicate, copy, sell, resell, reproduce, or otherwise speculate the Services, entirely or partly, for any reason without Synergetica’s explicit written agreement;
• take actions in connection with the Services that may be considered illegal or insulting including, but not limitated to, “hacking” the Services, or violating the intellectual property or other proprietary rights of Synergetica or third-parties.

In addition, where the Services are a game and/or application, Synergetica grants you a revocable, non-exclusive, non-transferable, limited license to use the application and game for your personal, non-commercial use, unless specified otherwise. The application or game may not be copied, duplicated, resold, or sublicensed. These Terms apply to all versions and updates to the applications and games, including, without limitation, free and paid versions.

3. THIRD PARTY SERVICES

Synergetica Services may include links to third party services over which Synergetica has no control. Synergetica is not responsible for the availability of such external sites or resources and will not be responsible or liable for any content, advertising, products, gameplay recording and sharing, social medial connectivity or other materials or actions on or available from such third-party websites or resources. These services are subject to respective third party terms and conditions. Please read these third party terms and conditions carefully as they state an agreement between you and the applied third party service provider.

4. ACCESS TO SYNERGETICA SERVICES

By using the Services, you confirm that you are at least 18 years old (or have reached the age of majority if that is not 18 years old the place you live) or that you have studied these Terms with your parent or official guardian and they consent to these Terms on your behalf and take full responsibility for your compliance with them. If you are under the age of 13, you must have permission from your parent or official guardian in order to use the Services. If you do not have permission from your parent of official guardian, certain features and functionality of the Services may be inaccessible. Information regarding use of your personal information can be found in Synergetica’s Privacy Policy or in the privacy policy of the Service you are using.

You may be required to register an account before using certain Services. Your may not rent, lease, sell, present, or grant otherwise it to anyone else. You consent to provide true and complete information about yourself when you register your account and to keep it updated. You may not have more than one account. You are entirely responsible for handling the confidentiality of your password and username and for any activities in your account. Synergtica does not authorize use of automated methods to sign up for an account, and Synergetica reserves the right to immediately terminate your access to the Services or your account if you violate these Terms or any applicable law in your jurisdiction.

5. VIRTUAL CURRENCIES/ITEMS

The Service may include the option to earn, buy virtual, in-game currency (“Virtual Currency”) as well as virtual, in-game items (“Virtual Items”). This can only be done only if you are considered a legal adult in the place you live. Virtual Currency and Virtual Items are not real money, do not have monetary value, and may not be redeemed for legal currency, or items of value outside of the Services.

All Virtual Currency and Items are considered to be final and non-refundable, unless stated otherwise at our judgement.

Synergetica has entire control over all Virtual Currency and Items and has the right to change the value at any time, change and/or liquidate any Virtual Currency and Virtual Items without any liability.

No refunds will be given by Synergetica. The Virtual Currency and Virtual Items have no real currency value, cannot be refunded by real money, and can only be used within the Games offered by Synergetica. In case your account is terminated or suspended for any reason, in Synergetica’s entire latitude, or if Synergetica discontinues its Games, you are deprived any and all Virtual Currency and Items.

Virtual Currency and Items may have an expiration date. If your Virtual Currency or Items expire and you still have an active Account, Synergetica may offer conversion of such Virtual Currency into Virtual Items for you in its sole discretion, however Synergetica is not obliged to do so.

6. INTELLECTUAL PROPERTY OWNERSHIP

You accept that all intellectual property rights in our Site, Service, Games and the underlying technology, and all data and content available on our Site and through the Service, excluding user content, but including the Games, logos, Virtual Currency and Items are owned by us and/or our vendors (including other users).

The Service content is protected by copyright laws throughout the world. Synergetica grants you a non-exclusive, revocable, limited license to view and use the Service content for your personal non-commercial use. You confirm that any copy of the Service Content you make will retain all copyright notices in the same form as the original one.

You may not otherwise use, post, display, perform, reproduce, publish, download, upload, print, license, transmit, modify, disassemble, adapt, distribute or transfer any Service content in entirely or partly without our prior written agreement. We and our suppliers (including other users) reserve all rights not granted in these Terms.

All trademarks, logos and service marks displayed on the site or Service are our property or the property of other third parties. You are not allowed to use these signs without our prior written agreement or the consent of such third parties.

7. DISCLAIMER OF WARRANTIES

SYNERGETICA MAKES NO REPRESENTATION, WARRANTY OF THE SUITABILITY OF THE SERVICES FOR YOUR OWN PURPOSES, OR THAT THE USE OF THE SAME WILL BE SECURE, ERROR-FREE, FREE OF VIRUSES, UNINTERRUPTED OR OTHER DAMAGEFUL COMPONENTS, OR FUNCTION PROPERLY IN COMBINATION WITH ANY THIRD-PARTY TECHNOLOGY, HARDWARE, SOFTWARE, SYSTEMS OR DATA.

THE SERVICES ARE PROVIDED “AS IS" AND ALL REPRESENTATIONS, CONDITIONS AND WARRANTIES, WHETHER EXPRESS, IMPLIED OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTY TITLE OR NON-VIOLATION ARE AGREEMENT HEREIN DISCLAIMED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. FURTHER, SYNERGETICA MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE CONTENT, DATA, MATERIALS OR PRODUCTS AND SERVICE CONTAINED THEREAT.

8. TERMINATION

We reserve the right to terminate or suspend your account or access to any or all our Services for any reason and at any time. Synergetica has the right to terminate your account if you breach these Terms. In case we terminate or suspend your account, you will have no further access to your account or anything associated to it. You will not be refunded of any Virtual Currency or Items earned or obtained during using our Services.

9. GENERAL

These Terms, along with the Privacy Policy, and any other third party privacy policy you are using, contain the complete and final consent between Synergetica and you and may not be changed by you except in a writing diligently signed by you and an authorized representative of Synergetica. Synergetica and you are independent parties and nothing in these Terms creates an employment. You agree that your violation of these Terms will cause Synergetica immediate and irreparable harm and Synergetica will be authorized to grant an interlocutory injunctions.

Synergetica may make changes to the Services, these Terms, or its Privacy Policy from time to time. Synergetica will use reasonable efforts to inform you about any material changes.
